| Outcomes |
Students are able to (1) identify and apply the relevant law to international sale of goods contracts; (2) explain with reference to international conventions (such as the Hague Rules, Hague-Visby Rules, and Warsaw Convention) how international carriage of goods is regulated; (3) describe the various methods of payment used in international trade and the rules that govern them; (4) discuss the legal principles that apply to marine insurance contracts; and (5) display an understanding of the laws governing international dispute resolution. |
| Content |
This unit is an introduction to the legal framework for international trade and explains the relevant international and domestic laws which affect that activity. Emphasis is placed on the treaties and conventions which are crucial to international commercial transactions. The five major areas of study are international sale of goods; settlement of commercial disputes; carriage of goods (by sea and air); payment in international trade; and marine insurance. Students completing the unit gain a better appreciation of the legal complexities associated with international transactions. Students who intend to work in any area involving international trade or commerce would find the unit very useful and relevant. |
| Assessment |
This comprises tutorial attendance and participation, a take-home assignment and a final examination.
Supplementary assessment is not available in this unit except in the case of a bachelor's pass degree student who has obtained a mark of 45 to 49 and is currently enrolled in this unit, and it is the only remaining unit that the student must pass in order to complete their course. |
