| Outcomes | Students are able to (1) demonstrate understanding of the principles of negligence in the context of claims for pure mental harm and pure economic loss, vicarious liability, non-delegable duties and other instances of liability for harm done by others, trespass to the person, nuisance and defamation; (2) engage in informed and articulate oral discussion of political, social and philosophical issues surrounding tort law; (3) read and analyse tort cases; (4) solve legal problems which raise torts issues; (5) conduct comprehensive and accurate research into a torts issue using both primary and secondary sources; and (6) write a critical essay which contains an accurate analysis of the law and convincingly presents the writer’s thoughts, arguments and conclusions. | ||
| Content | This unit examines the special principles of liability that relate to negligence actions for pure economic loss and pure mental harm (often called nervous shock or psychiatric injury); and the rules relating to vicarious liability and non-delegable duties, which determine whether someone other than the individual tortfeasor is a potential defendant. The unit also considers a representative selection of other torts including trespass to the person, nuisance and defamation. | ||
| Assessment | Students are required to attend and participate in seminars, submit a research essay and complete an end-of-semester examination. Supplementary assessment is not available in this unit except in the case of a bachelor's pass degree student who has obtained a mark of 45 to 49 and is currently enrolled in this unit, and it is the only remaining unit that the student must pass in order to complete their course. | ||
